Antitrust Guidelines Summary

 

Noerr-Pennington Antitrust Immunity.

Much of the activity of CCFC will involve petitioning and interacting with governmental bodies and officals and, thus CCFC is likely to enjoy Noerr-Pennington antitrust immunity because of the level of interaction with government and common interest of various governmental entities in promoting the association's goal.

Antitrust Considerations, Guidelines.

A detailed set of antitrust guidelines for CCFC and related activities involving competitors is provided (click here for detailed guidelines). These guidelines are not simply a primer on antitrust law and legal obligations. Rather, like programs to encourage “defensive driving” practices, they are intended to both provide guidance on avoiding any perception of any anti-competitive behavior and emphasize the pro-competitive effects and impacts of the association's objective and goal.

The antitrust guidelines apply to pre- and post-incorporation activities and all other common activities related to promoting the objectives and goals of CCFC, whether or not carried out directly under the auspices of the CCFC.
